Nexus Holidays reserves the right to update or amend these Terms at any time prior to you making a reservation. An up-to-date copy of these Terms is accessible on Nexus Holidays website www.nexusholidays.ca. The Terms as listed online when completing a reservation are those that control.

Payment of deposit and/or final payment are an acknowledgement of receipt of these information & conditions and constitutes acceptance of such as outlined.

You are responsible for providing and verifying full, complete and accurate information for all participants and services at the time of reservation. Under no circumstances is Nexus Holidays liable for any errors or omissions in the information provided by you to complete the reservation. If you do not notify Nexus Holidays of any error within 7 days of making the reservation, you are solely responsible for all fees assessed due to incomplete, erroneous or inaccurate details.


PRICING:

Nexus Holidays departures are priced in CAD dollars except for those prices listed in other currencies. Prices shown are per person, based on two people sharing a room. Prices do not include airfares, except package prices were noted on specific itineraries, and are subject to change without notice.

Pricing for our trips and services are subject to change at any time prior to receipt of full deposit.

Price inclusion and exclusion refer to specific itineraries, and are subject to change without notice.



DEPOSIT AND FINAL PAYMENT DATE:

At the time of reservation, a non-refundable, non-transferable, per person, per trip deposit is required. The deposit amount is dependent upon the trip and services booked.

Full payment is required by the final payment date. The final payment date is dependent upon the trip and services booked. See “Deposit & Final Payment Schedule” below.

If you do not pay the full invoice by the final payment date, your reservation and all services on the reservation, will be cancelled, and your deposit, airfare and travel insurance premiums will be forfeited.

Travel Insurance payments are always non-refundable.

Reservations made after the final payment date require full payment at the time of reservation.

Your reservation is confirmed when your initial deposit payment is processed. Your invoice, when documented as payment received, is confirmation of services on the reservation.

In the event the price listed, quoted, or confirmed is incorrect due to a system error, human error or other error, Nexus Holidays reserves the right to correct the price and reinvoice you at the correct price.

In additional to paying the deposit amount, for air-inclusive package, additional payment may be required for international flights before the final balance due date. Full air payment is required at the time of issuing the flight tickets, any cancellation or changes to the flight schedule will result in airline penalties at your own expense.


FEES AND CHARGES

All air-inclusive prices are based on group travel and any deviation from the set itinerary may incur additional airline ticket costs (Breakaway Fee). Arrangements such as transfers, accommodation, etc., outside the set group arrangements/dates are at an additional cost and are not covered by the Breakaway Fee.


AIRLINE FUEL LEVY SURCHARGE

Since 2004 all airlines have been charging a fuel levy surcharge, on top of the normal airline ticket price, in order to cover the increased cost of aviation fuel. As fuel prices may fluctuate, so too will the amount the airlines charge for this levy. This amount will be advised to you at the time of your booking and is subject to change until your flight ticket is issued.


AMENDMENT & BOOKING FEES

If you vary your booking, other than by transferring your tour package, tour departure date or name transfers, an amendment fee of $50.00 applies. Amendments made within 60 days or less before the tour date of departure will incur heavy penalties.

Transferring between tours (61 days or more) incurs a $100 per person administration fee. Transfer fees must be paid at the time of change.

Transferring between tours within 60 days or less of the tour departure date will be regarded as a cancellation.

Reissue of airline tickets – from $300 per person (other fees may apply).

Once a booking is confirmed, name transfers are not permitted as this will be regarded as a cancellation.



CANCELLATION BY CUSTOMER

All cancellations must be made in writing to Nexus Holidays and will be subject to the following cancellation charges from the date the written cancellation is received. Cancellation fees include all services on the reservation, except Travel Insurance, which is always non-refundable. Cancellation fees schedule listed below unless listed on flyers/brochures for specific itineraries.

Land Only and Air-inclusive packages other than cruise-related program:

1.     60 days prior to departure: loss of deposit plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

2.     59-46 days prior to departure: 35% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

3.     45-31 days prior to departure: 50% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

4.     30-16 days prior to departure: 75% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

5.     15 days or less prior to departure: 100% of tour cost



Cruise-related programs:

1.     90 days prior to departure: loss of deposit plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

2.     59-46 days prior to departure: 35% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

3.     45-31 days prior to departure: 50% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

4.     30-16 days prior to departure: 75% of tour cost plus any administration fees (Visa, airline cancellation fees and any applicable amendments).

5.     15 days or less prior to departure: 100% of tour cost


For international airfare inclusive trips, additional per person, non-refundable, non-transferable deposits and payments are required for your international flights. These are in addition to the deposits and payments above. Air-inclusive trip pricing is guaranteed upon receipt of deposit or payment in full for the entire reservation as specified in the information below. Once Nexus Holidays receive the payment, ticket will be issued. Cancellation fees are subject to airline and airfare contracts in addition to the above tour cancellation fee.


CANCELLATION by NEXUS HOLIDAYS

Nexus Holidays reserves the right to cancel or reschedule any trip departure for any reason, including insufficient demand, strikes, lockouts, riots, stoppage of labor or Force Majeure Event.

In the event of a cancellation by Nexus Holidays prior to departure for reasons excluding Force Majeure, Nexus Holidays will try, at your discretion, to rebook the same trip with a different departure date, or a similar trip, but there is no guarantee of availability. Nexus Holidays will refund the difference in price if the alternate is lower. You are responsible for additional costs if the alternate is higher. If this rebooking option is not acceptable to you, Nexus Holidays’ only responsibility is to refund the amounts paid by you for the reservation.

In the event of a cancellation by Nexus Holidays prior to departure or during your trip for conditions under Force Majeure, Nexus Holidays will provide a future travel/booking credit for the portion of your trip impacted, except visa cost and any cancellation fees levied by airlines and other third parties. Future travel/booking credit will be redeemable for travel with Nexus Holidays for one year from your original trip start date.

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.


REFUSAL OF CARRIAGE

Nexus Holidays retains the right to remove customers from our group for reasons that impact on the enjoyment or safety of other tour members, such as, but not limited to, the physical, medical or mental inability of customers to undertake the arrangements of the tour, unsocial or unruly behavior, or the carriage of prohibited substances and materials.


HOTEL DESCRIPTIONS, MAPS & PICTURES

Any hotel descriptions are based on current hotel guides provided by suppliers and contractual agreements. Any facilities described are subject to change at any time. Maps and photographs are included for general information only and may not necessarily reflect actual routing, location or services. Nexus Holidays has made reasonable enquiries to verify that the descriptions and details are accurate but does not warrant that they are.


TRAVEL INSURANCE

Nexus Holidays strongly recommends that all customers be adequately covered by insurance for the duration of their travel arrangements. Nexus Holidays cannot be made liable for any cost incurred by the customer on any tour of not adequately insured.


HEALTH REQUIREMENTS

All customers must possess physical and mental fitness well enough to travel and are required to familiarize themselves with any health requirements specific to the countries being visited. Customers with a pre-existing medical condition that affects their fitness to travel, or any medical/dietary requirements must advise Nexus Holidays when booking their tour and may be required to provide written confirmation from their doctor that they are fit to travel. All customers should visit their doctor to confirm that they are physically able to undertake the day-to-day requirements of the tour.

Check with your healthcare provider for up-to-date requirements. You may also check the Public Health of Canada website (https://www.canada.ca/en/public-health/services/travel-health.html) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients' health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be removed from the group and directed to a local medical facility for diagnosis. Only upon written clearance by an accredited medical facility that the guest is able to participate in the remaining activities of the tour will that individual be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will be the responsibility of the passenger.


BAGGAGE

The standard check-in baggage allowance for most airlines is limited to one piece and must not exceed 20KG and carry-on baggage is limited to one piece and must not exceed 7KG. Baggage allowance is subject to airline polices.


TRAVEL DOCUMENTS

A passport with a minimum of six months validity is required for customers travelling to all countries in our program. Non-Canadian passport holders will incur additional fees. Visa costs are not included in tour packages unless otherwise explicitly stated. If passports are not received by Nexus Holidays 60 days prior to departure, at the specified time the customer may be required to pay an urgent visa processing fee. Responsibility for documentation accuracy, passport validity and dispatch of documents rests with the customer. Nexus Holidays accepts no responsibility for any failure in this respect. Nexus Holidays does not issue foreign visas. We only submit passports and application forms for visas to be issued by the relevant authorities. Nexus Holidays cannot guarantee that any visa will be issued by the relevant authority and accepts no responsibility if a visa application is refused. Any cancellation fees or other expenses incurred by the customer due to the refusal of a visa will be entirely the customer’s liability.


SEAT ASSIGNMENTS

Seat assignments are not guaranteed even after they are assigned and Nexus Holidays has no control over airline seat assignments. Airlines and Nexus Holidays reserve the right to change seat assignments at any time without notice, for any reason. Most airlines charge a fee to pre book a seat.



SINGLE TRAVELERS

If travelling alone a single supplement surcharge will apply. Single supplement fees are also applicable for any rail or cruise components and cannot be waived.


Tipping

Complete tipping guidelines are provided with final travel documents and on each program's tour flyer and brochures. Tipping amounts are based on the tour itinerary and length and are subject to change. The amount payable for each tour is shown in the tour descriptions and Nexus Holidays will advise the exact amount required per person at the time of booking.


SHOPPING

Nexus Holidays and its employees are not qualified nor permitted to ensure or guarantee the quality or value of any good purchased or the suitability of any retail outlets visited. In all cases the purchasing of goods and the use of a credit for those transactions is entirely at the customer’s own risk and at all times the customer must use their own discretion.


CHANGE OF ITINERARY

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

While Nexus Holidays endeavour to operate all trips as described, we reserve the right to change the trip itinerary. Please refer to our website and your final itinerary before departure for the most recent updates. 

We reserve the right to change an itinerary due to local circumstances or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you.

Nexus Holidays is not responsible for any incidental expenses that may be incurred as a result of any change in itineraries including but not limited to visas, vaccinations or non-refundable or non-changeable flights.


AUTHORITY ON TOUR

In any trips run by a Nexus Holidays’ group leader, the decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited.


ACCEPTANCE OF RISK

You acknowledge that the nature of the trip may be adventurous, and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives.


You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip.


Nexus Holidays use information from local government tourism boards and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.


RESPONSIBILITY

Nexus Holidays acts as an agent for and make arrangements with airlines, cruise lines, hotels, bus lines and other independent parties to provide you tour services. Nexus Holidays does not own, manage, control or operate any transportation vehicle, any cruise, any hotel or restaurant or any other supplier of services. All coupons receipts and tickets are issued subject to the terms and conditions specified by the supplier and all services are subject to the laws of the country where the services are provided. Nexus Holidays and affiliates shall not be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing services, or any insurer or insurance administrator under any travel insurance provided by Nexus Holidays, or of any other person. If the services included in the cruise cannot be supplied or there are changed in an itinerary for reasons beyond the control of Nexus Holidays, we will arrange for the provision of comparable services, when possible. Any resulting additional expense will be payable by the customer.


PROCEDURES FOR LODGING COMPLAINTS OR CLAIMS

At Nexus Holidays, we are committed to ensuring that we deal with complaints effectively and efficiently. Should the customer not be satisfied with any aspect of their arrangements they must immediately inform the group leader or local guide who will endeavour to resolve the issue at the time. If this is not possible and you wish to lodge a complaint or claim this must be done in writing to Nexus Holidays in Canada within 30 days of the date of the completion of your Nexus Holidays arrangements. Relevant receipts and substantiating evidence must be attached to the letter of claim.


ADDRESSES

By providing email and postal addresses on the Reservation Form, you have agreed to receive correspondence from Nexus Holidays which may contain marketing, specials and promotional material.


BROCHURE VALIDITY

Tour itineraries and prices in the brochure/on the website are accurate at the time of publishing and prices are based on exchange rates as of December of the previous year. Once a customer has paid in full, the price of the tour is guaranteed, subject to any tax changes or levies imposed by any government or their agencies or any airline. The prices for tours in the following year are subject to change with out notice. Nexus Holidays reserves the right to make alterations to itineraries, departure dates and prices due to circumstances beyond their control.


AGENT RESPONSIBILITY

It is the travel agent’s responsibility to ensure that all invoice and itinerary details and documentation issued by Nexus Holidays are correct and that the customer is aware of amendment and cancellation conditions and other clauses in the Booking Conditions.
